In less than 4 months’ time the UK will leave the European Union (31 December 2020). At the time of writing there is no agreement in place to determine what the status of goods (including business aircraft) imported into the EU (including the UK and Isle of Man) before 31 December 2020 will be.

In the newsletter attached Martyn Fiddler Aviation outline the list of possible results, explaining the impact of each scenario and the work that will be requested of aircraft owners in order to remain in free circulation in both the UK and the EU.

In this short article we will ask ourselves what leaving the EU with or without a trade deal could mean for the VAT status of business aircraft that have been imported into the UK or the EU, consider whether or not aircraft they will lose their imported status, and explain what action will need to be taken in the event of each scenario.

As the transition period of the ‘new’ Union Customs Code (UCC) now enters its final stage, those traders who have not yet renewed any customs approvals or applied for any they require only have a matter of months to get these in place.

29 March 2019 is fast approaching and there is still no decision or agreement between the EU and UK regarding the customs union. Similarly there is no decision of what the status of goods currently in free circulation in the EU/UK will be after 29 March 2019. With effect from 1st January 2018, the End Use process for aircraft has been removed in the EU. This customs process affected the import duty applicable to aircraft and carried a requirement that only EU entities could gain duty relief. This has been removed which is a welcome change, however, there is still technical detail to be issued by individual member states on the matter.
